The Problem

A European conservation nonprofit sought to engage environmental researchers in South Africa for a regional biodiversity program but faced significant legal constraints. Without an entity, they could not employ directly or comply with South Africa’s Basic Conditions of Employment Act (BCEA), Unemployment Insurance Fund (UIF), and Pay-As-You-Earn (PAYE) tax system.

Attempts to hire contractors had been flagged by their legal advisors as “disguised employment,” exposing them to compliance and reputational risks.

The Solution

Procloz offered its Employer of Record service to act as the legal employer under South African law. Employment agreements were drafted in accordance with the BCEA and Labour Relations Act (LRA), covering statutory annual leave, sick leave, and notice obligations. Leveraging our compliant payroll infrastructure, we managed monthly processing of SARS (South African Revenue Service) submissions, UIF, and Skills Development Levy contributions.

Procloz also aligned compensation structures with local cost-of-living standards, balancing donor budget frameworks with fair pay principles. The full onboarding process was completed within ten days after contract negotiation and offered a seamless interface for the client’s HR team to integrate with Procloz’s payroll reporting dashboard.
