Procloz is now an on-hire labour sponsor

As an approved sponsor with an on-hire business, overseas workers can be assigned to work at a third party. However, the business must remain the direct employer of all overseas workers sponsored under an on-hire industry labour agreement, and overseas workers must receive their salary on a regular basis in line with Australian legislation. It is designed to assist employers in addressing immediate skills needs, whilst ensuring that opportunities for job-ready Australians are protected. A visa granted under a labour agreement will be a Temporary Skill Shortage (TSS) visa (subclass 482).

Labour agreements are formal contracts established between Australian employers and the Australian Government. These agreements facilitate the sponsorship of overseas workers for skilled visas, allowing them to work in Australia for a specific duration in approved occupations.

Approved Sponsors and Recruitment

A business that enters into an on-hire labour agreement becomes an approved sponsor. This designation empowers them to nominate and recruit overseas workers in the specified occupations. This process streamlines the hiring process for clients by eliminating the need for them to obtain their own license to sponsor foreign workers.

Simplified Hiring Process

Clients can engage overseas workers through an on-hire labour agreement without the requirement of a Standard Business Sponsorship (SBS). This simplifies the hiring process for businesses seeking to hire foreign talent, making it more efficient and accessible.

Sponsor Nomination

To obtain a Temporary Skill Shortage (TSS) visa, an employer must first meet labour market testing (LMT) requirements. This involves demonstrating that a suitable Australian worker is not available for the position. To meet LMT requirements, the employer must advertise the position for at least 28 days within the four-month period preceding the nomination application. The advertisement must include the employer’s name, a complete job description, and the offered salary or salary range. Additionally, the employer must commit to paying the annual market salary to the nominated employee.

The Visa Application

In order to apply the applicant must meet minimum English language requirements (unless exempt) and be able to prove two of the last five years full time paid work experience. Generally, pay slips and employer references will be required to prove this element.
